Epic Games is once again taking legal action against Apple, asking a U.S. court to intervene in the ongoing dispute over Fortnite’s removal from the App Store. In May 2025, Epic moved with District Judge Yvonne Gonzalez Rogers to force Apple to reinstate Fortnite to the App Store in the U.S. Apple purposefully will not review Epic’s resubmitted Fortnite app as revenge for their ongoing lawsuit, Epic alleged. Epic contends this sneaky maneuver flouts a prior court order that banned Apple from blocking apps that offer alternative payment methods.

The company accuses Apple of failing to keep promises made to the court or its own policies for the App Store. Apple, however, insists it is operating within the law. The tech giant says it will not actually make moves until the Ninth Circuit Court weighs in on Apple’s application to halt parts of the earlier decision. Apple claims it is waiting for appropriate legal clearance before Fortnite can return. Epic disagrees and says the delay is already doing damage.

Fortnite has been removed from the EU App Store as well, in what seems to be a response to the rejection of the U.S. version that Epic claims is related to Apple denying the request. Apple had warned Epic to resubmit the app with no availability in the United States to avoid any issues, the report said. Now, Epic is asking the court to force the two companies to reach out again to comply with the previous judgment.

The company would like Apple to be compelled to approve any Epic app that conforms to standard App Store rules, which include Fortnite. Epic is also asking the court to find Apple in contempt for defying the earlier order. The court’s upcoming decision could significantly affect not only Fortnite’s future on iOS but also broader developer rights related to app distribution and alternative payment systems on Apple’s platform.
