Reliance Jio accuses Paytm for dragging Indian Telecom Companies to court

One of the partners of Paytm, One97 Communications reached the Delhi High Court against all the telecom operators i.e. Jio, Vodafone Idea, Bharati Airtel, MTNL, and BSNL at the beginning of this month and blamed they all are not taking any action against spam calls and fraudsters.

Reliance Jio hammered the digital payment giant for this move and also stated, through this action Paytm is trying to shift the eyes of law from its financial frauds. Instead, it said to the High Court as per the Telecom Commercial Communication Customer Preference Regulation (TCCCPR) 2018 no telecom company is responsible for any kind of fraud activities happen over the call or via SMS.

“Under Section 79 of the IT Act, intermediaries are exempt from liability under the Act in respect of any third-party information, data, or communication link made available or hosted by them,” – Jio.

Jio also said the telecom Authority of India (TRAI) is “not empowered to itself act on fraudulent/unlawful activity, nor can it impose any legal obligation in this regard on service providers.”

In the court, One97 Communication also claimed ₹100 crores as a “financial and reputational loss” fulfillment and claims the telemarketers are needed to get verified before granting them to access customers’ data. The next hearing is on 24th June.
