Cyberpunk 2077 Developers Possibly face Class-Action Lawsuit by Investors

Cyberpunk 2077’s Polish developers are set to face the consequences of a disastrous launch as a law firm has indicated that it is considering a class-action lawsuit against them.

As reported by the New York Times, a Warsaw-based lawyer Mikołaj Orzechowski, who is also a CD Projekt Red (CDPR) investor has indicated that they are exploring the possibility of suing, alleging that to secure funding, the studio may have misrepresented itself to investors.

According to a briefing prepared by the lawyer, others who have been affected by the suspension of Cyberpunk 2077’s sale are invited to be a part of the lawsuit. 

New York-based Wolf Haldenstein Adler Freeman & Herz LLP, who has extensive experience in the prosecution of securities class actions, has also announced it is looking to represent shareholders who’ve incurred losses “resulting from allegations that CD Projekt may have issued materially misleading information to their shareholders and investing public”.

Following Sony’s decision to temporarily remove Cyberpunk 2077 from the PlayStation Store, CD Projekt has seen its stock value drop further 15 percent. This is a 40 percent decline since December 4 due to the buggy launch and negative reviews.

The developer is also facing criticism for its use of crunch during the development of Cyberpunk. CD Projekt broke its promise to not force compulsory overtime for its employees to finish the project as in September 2020 it told its employees that they would have to work six-day weeks until the game’s November launch (the game was subsequently launched in December).

Despite the buggy launch, CD Projekt bosses have told staff they will get their full bonuses, and executives of the company reportedly have held themselves responsible for the state of the game at release.

Eurogamer also reported that there is now news about Cyberpunk 2077 save files becoming permanently corrupted for players if they exceed 8MB in size. Though initially it was reported as an all platforms issue, some now suggest it’s just a PC issue. However, without confirmation from developer CD Projekt Red, either way, players have been advised to “keep a lower amount of items and crafting materials”.
